What is the Party Wall etc Act 1996?

The Party Wall etc Act 1996 provides property owners with certain rights and obligations to other owners of buildings in relation to party walls and similar structures. It also provides a framework for a more disciplined approach to exercising these rights and for preventing and resolving disputes.

The Party Wall etc. Act 1996 requires that in certain circumstances it is necessary to serve a formal Notice upon your neighbour indicating that it is your intention to exercise certain rights under the Act. This is necessary in a number of situations, for example:

when the proposed construction is likely to have foundations within 3 metres of an adjoining or adjacent property, or within 6 metres of an adjoining or adjacent property and at a lower level
